DMCA Policy
Brie Bites respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Brie Bites will respond expeditiously to claims of copyright infringement committed using the Brie Bites service or website (the "Site") if such claims are reported to Brie Bites's Designated Copyright Agent identified in the sample notice below.
Filing a DMCA Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Brie Bites's Designated Copyright Agent.
- Identification of the copyrighted work claimed to have been infringed: This means a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled: This should include a description of where the allegedly infringing material is located on the Brie Bites Site (e.g., URL link).
- Information reasonably sufficient to permit Brie Bites to contact you: Such as an address, telephone number, and, if available, an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Brie Bites by submitting the following information to our Designated Copyright Agent:
- Identification of the material that has been removed or to which access has been disabled: And the location at which the material appeared before it was removed or access to it was disabled (e.g., URL link).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which Brie Bites may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
All DMCA notices and counter-notifications should be submitted through our contact page, clearly indicating "DMCA Notice" or "DMCA Counter-Notification" in the subject.
